Emergency Court New Jersey
My question involves a child custody case from the State of: NJ
My sisters ex-husband, demanded male children return to his residence in NJ. The children are now at his residence. The children do ->NOT<- want to be there and are now suffering great emotional distress.
Father told them they had to make a "choice" to live with mom or him.
They choose Mom. Hours later, he demanded they now live with him.
The children stated they will tell a judge they want to live w/ mom.
Today, the father has legal custody. The children wanted to try to live with the father. My sister gave up custody in effort to make the transition peaceful. Months ago the father was evicted from his residence and the children moved in with mom @ grandparents, [In NJ] was the only immediate residence to take them.
My sister has re-filed for custody, but the case hasn’t been heard yet.
Ways/means to resolve this as ASAP?
Thanks
Re: Emergency Court New Jersey
She and her lawyer can bring a motion for temporary custody with the court hearing the case. I don't have enough facts to even begin to guess as to her odds of succeeding.
