    My question involves collection proceedings in the State of: New York

    My husband and I are both self-employed and our business went down sharply in the economic downturn. We fell behind on a Capital One credit card and we contacted them trying to work out a payment arrangement. They refused to work with us and we are now several months behind.

    My husband has an estate account for his deceased relative for which he is a 'personal representative' and the bank which has this account has just been bought by Capital One. Can they go after this account? It has its own tax id number. Many thanks for any advice.

    If the account is clear that he is not owner of the money, but is managing somebody else's funds, it shouldn't be subject to garnishment.
