Child Name Change During Naturalization
My question involves name change laws in the State of: Florida
Hi, I am a permanent resident in Florida and I have some questions on the child name change. Since my daughter and son have an original country’s first name, I’m trying to change their names. My family will be able to apply for the citizenship in January 2010, but I am not sure I can change their names by the N-400 application for naturalization. I found the option for the adult name change, but the option for child name change doesn’t seem to be available. My questions are followings:
1. Can I change their names through the N-400 application by adding their preferred names on Part 9 of the N-400 application?
2. If Question 1 approach is not allowed, can I change their name through the file for use of “Florida minor name change forms”? Can this form be used for the name change even for a permanent resident?
3. What would be a right step to change the name change? N-400 application first or child name change first? Which one is the first in order?
Please let me know. Thank you very much.
Re: Child Name Change During Naturalization
The USCIS has no authority to change anybody's name. The request for a name change on the N-400 form is a request to a court that administers your Oath of Allegiance to change your name at the same time, such that if the court grants your request your new name appears on your Certificate of Naturalization.
You appear to be talking about changing only their first names, not their surnames? My approach would be to play it safe by doing that before filing the N-400/N-600's, and documenting the name changes with your naturalization petition.
Re: Child Name Change During Naturalization
Mr. Knowitall,
Quick search in the forum didn't show me the exact situation I have.
My wife & son (from her previous marriage) have temp Green Card, and we will need to file Petition to remove Condition on Residence (I-751) within next 3 months. We would like to have the boy's name changed (last name to follow my family name) prior to filing the Petition, if all possible.
Interpretting your response, should I do the name change based on State of Texas requirement, and file the petition WITH the name change documentation? Or could we cause confusion and possible Petition denial from USCIS?
I learned to be very thorough in working with USCIS, and I would like to be sure that I have covered everything.
Your assistance & feedback are greatly appreciated
