Underage Consumption in Georgia
My question involves criminal law for the state of: Georgia.
We had 8 friends over and had a total of fifteen beers between all of us. The police came and asked all of us if we had been drinking to which all of us replied yes because we were told that if we were upfront with him we would be ok so we all answered truthfully. He then threw out a marijuana pipe they had found and said that since there was no mandate against that from his department he wouldn't be charged. He then wrote us all citations saying that we had admitted to being drunk and all had an odor of alcohol, which we didn't. He then made all of our parents come and get us. I'm 19 and am completely independent from my parents. This happened at my house and the police made my parents take me home, an hour both ways.
This harkens of entrapment to me although I know that won't stick on an officer of the law. WE were not breathalyzed as neither of the two cops there were in possession of their equipment. None of us were drunk having less that 1 beer per person on average. What should I do? Should I move my date since they made a mistake on my ticket(they were off by two days)? I asked them to breathalyze me and they said no since they already had an admission. Any help is greatly appreciated.
Re: Underage Consumption in Georgia
Basically you threw a beer party at your house for a bunch of minors and got caught? Entrapment? You mean a police informant provided the alcohol and enticed you to drink, when you otherwise would not have done so? Come on.
Your math is a bit off. If eight people consume fifteen beers, you've each had more than one beer by average.
It wouldn't hurt to consult a criminal defense lawyer.
What does "they were off by two days" mean? What date was "off"?
Re: Underage Consumption in Georgia
First of all, thanks for the response. It wasn't as if I hadn't heard all of that from my parents already. Second, do you have any real advice? Maybe some legal advice? He told us our court date was the 17th of December and we got a letter telling us it was the fifteenth. I heard the officer that wrote my ticket say he was going on Christmas vacation the week before. Does he have any say over the court date? Could he have moved it so he could be present and we would be prosecuted?
Re: Underage Consumption in Georgia
The court can reschedule your court date. That's not a defense.
Defenses don't fall from the sky like snowflakes. They're built from the facts. If you share any facts that might help establish a defense, we have something to work with. If you say "I'm guilty as sin, but I'm hoping for a miracle," well, you haven't given us anything to work with.
