Noise Complaints
My question involves landlord-tenant law in the State of: Indiana
I am 20 years old and I rent out my parents basement, by basement i mean it used to be half and every couple of weeks my "half" shrinks by at least a foot. at the moment i am living in a forth of the non finished and not up to code basement. i work later hours and stay over alot to get as many hours as i can and i don't usually get home until 2 and to sleep until 4 and i sleep until noon, not sleeping all day, the normal 8 hours just shifted a bit. i'm woken up at the least 3 times by people meaning to wake me up before noon and half the time they're blaring music upstairs and that wakes me up an hour or 2 before my alarm goes off. they say that its their house and they can be as loud as they want even though i pay to live here and that can't be right. is there anything i can do in this situation?

Why don't you leave home?

Re: Noise Complaints
You could always call your local code enforcement office and complain. But be sure to have some place lined up to go when they immediately ban you from staying there (and, I wouldn't count on your parents to bother fixing the issues to get you back in either, since you'd only be able to sue them for damages for the remaining portion of your lease). You DO have a written lease, right? What does that lease say about quiet enjoyment?
Most judges are going to agree with 525601; if you don't like living with your parents, then leave. Courts aren't going to see your financial contribution living under the family roof as "rent". Even 14 year olds with jobs can and do contribute to a FAMILY living situation, and you simply putting money in the family kitty isn't going to be seen as "rent" without a lease. What you have is a family living situation. If you want a landlord, then go get one.
