Parent in Jail
My question involves a child custody case from the State of: KS
i share 50/50 custody right now with my sons father who a few days ago got put in jail, with no bond avail (which means it will be a good length of time in). His grandmother (his dads mom), is trying to tell the school she can pick him up. I am in the process with legal aid and trying to find an attorney, but this is pretty crucial information to find out since tomorrow is his "day" and she believes she can take him although her son will not be avail needless to say. Does he continue his rights? and can his mother still pick my child up from school insisting he be there since its his fathers day? *fyi, my sons school unfortunately will allow anyone to pick up the child if he willingly goes with them after the bell rings...horrid and i am calling the school board tomorrow

What I had been told when my ex-husband was in prison is that they have rights - but they have "No Enforceable Rights"
Meaning - right now his mother has the same rights as any other grandparent, which is a Big Fat ZERO...
Do you have anything showing he's in jail? I'd take any paperwork you have, along w/ your court order, up to the school and tell them grandma absolutely is NOT to pick up your child from school. Threaten them w/ a lawsuit if you have to. But make it clear that under no circumstances is grandma allowed to pick up your child from school at this time.
Is there any way you can be there at the school before it lets out and pick him up a few minutes early?
