My question involves criminal law for the state of: NY
My son who is 18 was invited to party along with other kids. When he got to the house the doors were locked, but the girl who was 17 was in her room with music playing and could not hear them. He climbed thru a window to get the girl and they partied the rest of the night away. The mother found out what happened and he was charged with Criminal Trespassing in the 2nd degree. He stole nothing, was invited, was not drinking ( he was givine a breathalyzer at the police station). Is this right? a concerned father.
