Parents Rights in Ohio for Emancipation Law
My question involves emancipation laws for the State of: OHIO
:wallbang: I am at my end. My son will be 18 y/o on 12/03/09. Please understand I love my son. However he is on Juvy Probation for countless crimes. This is a on going problem from a early age. I've tried so many things. I have called many Team Meets to help my son. Needless to say we got nothing more than taken this for granted. Right down to his last run-away after run-away just 1 week before and cutting off leg tracker, court ordered. No matter what we try it falls on his deaf ears. Also along with countless P.V's his Probation Officer has filed there are unfiled ones as well. Bottom line with P.O. is she will not impose any law that would/could of helped him. Cutting leg tracker off is escape in itself. He steals and will not follow house rules. Yet this is no concern to the Court here. I do fear the safety of members in our home not to mention the publics as well. He says no matter what the Court will not do anything! So far this is true. He has not graduated with his class however, by the end of Dec. 2009 his teacher says he will have the last credits to graduate. I am asking can I have him removed from my home? If not can he be placed in a home that can keep him allowing him to get a job? He has had many jobs and all end in him being let go. He doesn't respect us nor work. He will not stay at the house even when on house arrest with or with out leg tracker. Even with our help he still remains in trouble. If we are forced to keep him under our roof can we have the law enforced und the same probation as a juvy on probation. The Courts plan to keep him on Juvy Probation. Can we charge rent? He is 18 y/o and it stands to reason if a body is 18 y/o then they need to act like so. Can the STATE of OHIO place him into a home that is better than home now? He has a drug issue as well. These actions of run away, drugs and doing as he pleases are going on at least 1 or 2 times a month now. So what we are doing is not help to him or us. Our home is in a upset and it seems we as parents see no end in site. When he does go to jail he gets in trouble there as well. Please what can be done?:confused:

How long is he to be kept on juvi probation?
Yes, you can charge rent. I'm not certain that you can be forced to keep him in your home past the age of 18 - generally, once Birthday #18 arrives, you can chuck his belongings out on the front lawn and change the locks. Until 18, though, you're legally and financially responsible for him.
By the time you could get in to have him declared incorrigible, he'd be 18 already.
