    Supervised Visitation Due to Immigration Status
    My question involves a child custody case from the State of: Texas

    I was going to marry the father of my child but once I found out that he was using me to get his green card and to use my house to hide illegal aliens I ended the relationship 2 weeks before the marriage and 6 weeks pregnant. I allowed him to see the baby but he didn't wanted to see him but wanted access to the baby legal documents (Social Security Number) I refused and he stop visiting my baby. He applied at the attorney General to get help to stablish rights over the baby. I at that time was having a corneal transplant and didn't know what he was doing but months later I filed a petition to have custody of my child-- asked the court to prevent parental child abduction since he is illegally in the country and he has threated with taking the baby from me. He never answered my petition but did show up for court hearings and signed the temporary orders. He has supervised visitation but doesn't talk or play with my child ... he sits on my sofa for four hours on the same place every Sunday. He asked for the child SSN to add him to his insurance--I know he cannot get health insurance because he is here illegally but he said that his employer told him that his ITIN is his SSN.

    What can I expect from my case given the situation?
    What is a Motion to retain? is that dismissal of my case? I have a court date for motion to retain.
    If he is the defendant why he also appears as the the defendant intervinor? What that means?

    What can you expect from what? A child custody proceeding?

    A motion to retain what? Read the motion and tell us what he's asking for.

    I'm not in a position to interpret his court pleadings, to know what he's asking for, or if the pleadings are in proper form. You should consider hiring a lawyer.

    You can take steps to prevent the children from being removed from the country, beyond whatever the current custody order says. Read this.
