Grandparents Rights in Minnesota
My question involves grandparents rights in the State of: MN. I live in NC and my grandson lives in MN.
My daughter passed away in June 2008. Now can't call or write to my grandson!!!!!!!! :mad:
I have tried everything i could and still can't get a phone # or address. I don't have a lot of money to hire a lawyer. I Really need some advise. Can someone help me PLEASE?

What kind of relationship did you have with this child? How often did you see the child before the relationship was severed? What reason was given for Dad to stop communication?

I talked to my daughter and grandchildren everyweekend and holidays. When ever i went home i spent a couple of days with them. The Dad said there is to much drama in my past? I just don't understand what he is saying. He will not call me and explain i had to hear it from someone else.

My heart goes out to you. Not only have you lost your child, but your grandchildren too! However, Minnesota does advocate for grandparents to be involved in their grandchildren's life, barring anything detrimental.
"257C.08 RIGHTS OF VISITATION TO UNMARRIED PERSONS.
Subdivision 1. If parent is deceased. If a parent of an unmarried minor child is deceased, the parents and grandparents of the deceased parent may be granted reasonable visitation rights to the unmarried minor child during minority by the district court upon finding that visitation rights would be in the best interests of the child and would not interfere with the parent child relationship. The court shall consider the amount of personal contact between the parents or grandparents of the deceased parent and the child prior to the application." It sounds like you have the legal standing to force visitation rights with your grandchildren, but yes, you would need a lawyer to do so. Most of the attorneys that I have met up here are willing to work on payment plans after the retainer is submitted (I'll even give you the name of my lawer, if you want it. He's great!).
So my advice to you is to save up for that retainer and while you're doing that, continue to try to contact your grandkids (make sure you document your attempts). Internet searches and companies such as Intellius are great tools to track down phone numbers and addresses.
Also, if you can find them, you should also try to send a letter or email to the children's father and attempt to resolve his concerns. I don't know if it will work, but it will be helpful to your case to show that you tried to resolve the situation peacefully, prior to court intervention.
