When To File Form I-130
Hi,
:? I would like to ask a question about the immigration to the usa. My parents are the legal Permanent resident of usa, they got the permit 2 years ago, i am also in here with student visa whereas my elder brother is back home. And he is getting married and he has been forcing to case file I-130 for immigration before he gets married.
My question is whether will it be safe to case file before marrige ?, I mean, or it's ok even after getting marrige. Is there any difference in the duration he has to wait for immigration to the USA if he gets married. And usually how long it takes to get immigration. Even I heard that, if he gets married, he will have to wait until our parents get the Citizenship of the USA. Is that so.
I would be greatful if some one could give me the best and detailed information about this, becuase we are totally unaware about this.

He's marrying a citizen of his country of origin?
-
ya he is marrying from his own native country, from Asia.
what if he get married after case file I-130, does that make any difference. or he will have to wait until his parents(Permanent resident) gets the Citizenship. if in any condition he is married.
Hope to get reply from you asap.

Once your parents are citizens they can sponsor him. If he's not married he has a higher priority for immigration, with a typical wait of about four years to be permitted entry from the date they file a valid petition; if he's married, he's a lower priority and may end up waiting seven or more years.

Hi,
Still i am confused, now i have only one simple question.
That is If somebody is not married yet, and he case a file I-130, then soon he gets married. Now my question is, will there be any difference if he case a file before his marrige or there is not much difference if he case a file after his parents get the citizenship.
His parents got the permanent resident around 2 and half years ago. And also usually how long it takes to apply for citizenship. And after how many successive years his married son will get his number, if he case a file before his marrige or after his parents gets the citizenships.
will highly appreciate your openions.

Again, if he marries, he falls into a lower category for family reunification and it will take longer for him to immigrate.

hi,
Thanx for getting the reply so quick
Actually, even this time i didn't get my desired answer to question. whether, is it me or you, you couldn't explain or i could'nt underdtand, It might be me, since i am a intl' school boy and do not understand english better.
Sorry to ask u the same questioin again and again,
My simple question is if he case a file I-130 early before his marrige and gets married.
By the time his parents get citizenship after 3 years, his number will be processing and will be far ahead in the que or,
such things doesn't happen, once he gets married he has to start from the very begenning after getting his parent's citizenship even though he case a file I-130 before his marriege 3 years before his parents got the citizenship.
thanx once again

Sure - his parents can apply while he is single, but his marriage would still change his priority. There should still be a net gain by starting the process at an earlier date.

thanx now i am more clear.
so if, he case file now then how many months or years he will be legibel or get his number earlier. once is get married. or there won't be much different.
