Grandparents' Guardianship
My question involves grandparents rights in the State of: Utah
My husband and I are petitioning the court for guardianship of our 10yr old ggson, residing with us since June this year and enrolled in school, since she has been homeless and out of work. After getting a job and planning on moving in with a friend, she now wants him back. What would it take to have her declared unfit? Her erratic behavior makes us suspect that she is either on drugs or is bi-polar. She smokes, drinks, does drugs, parties and sleeps around. Our grandson is allergic to cigarette smoke.
Any chance we can win the approval of a judge?

Outside of smoking and drinking, which are both legal, do you have undeniable proof to drug use that could put her in jail? If there isn't undeniable proof of abuse or neglect, you cannot violate your daughter's constituntional right to raise her child the way she chooses. She could suffer from all kinds of personality disorders and it wouldn't matter unless she is clearly without a doubt abusing or neglecting her son. This can't be your opinion that it is abuse. It must be fact.
