Continuing Employment of an Au Pair - J1/F1
    Good afternoon -

We have an au pair who is in her second year with us. She is on a J1 visa which will expire next summer. We would like for her to stay with us in some capacity after that visa expires.

Here is my question - is there a way for us to do so? She would like to go to school and we are willing to sponsor her. She would also continue on working for us with our children. I know there is an issue with working while on the F1 student visa - is there a way for her to be a student and work? Legally?

    Thank you!

Unfortunately, I doubt that you are going to find a way to retain her in an au pair-type capacity after her program ends. An F1 visa won't do it, and neither you nor she are going to qualify for a work visa such as an H1B for this type of work.
