Converting H1 Visa
Hi,
I was just informed yesterday by my employer that I might be replaced(meaning I am going to be replaced I guess),however they want me to continue working until they get a replacement for me. Really patronizing isn't it?
Well I dont know what to do.If I am terminated, can i switch to a student Visa? I was granted admission last year for a masters program which I had defer to spring next year. Generally, what are my options . Advice ?

Re: Converting H1 Visa
You can file to adjust your status, but keep in mind that a F1 visa is a nonimmigrant visa (not dual intent like an H1B). Also the issues of timing might be tricky - once you are granted F1 status you can no longer work for your H1B employer.

Re: Converting H1 Visa
Emy,
you have a few options. You can certainly change your status to that of a student (you must speak with the school first - and they usually have very good international student counselors). You can also transfer your H1b visa to another company, if that is available.
There may be other options, depending on your particular situation, especially if you want to continue working. Remember that as a student you will not be able to work, but generally, after your master's program concludes, you would be eligible for OPT (a one year work permit).
I hope this information is useful. Remember, this is not legal advise, but just general information. I would be happy to speak with you if you have other questions.
