    I-130 Form-Question 22: Marriage
    Can someone help me out with this questions, what does it mean??!!

    If your relative is not eligible for adjustment of status, he or she will apply for a visa abroad at the American consular post in:

    City and Country


    Does this mean, to put down the City and Country of Origin? (Where the person came from)

    I'm confused :confused:

    Also, if the person is eligible, does this need to be filled out? or can it be left blank?

    There are two parts to that question, and you need to fill out the one that applies to your situation depending on your circumstances.

    The second part you referenced means that if you spouse is NOT elgible for adjustment of status in the US, the assumption is they will have to apply for a VISA in their home country first and the adjustment of status will be reviewed/approved/denied in the US consulate of that country.

    Probably stil confusing! Can you give me your specific circumstances.

    Is you spouse currently in the US?
    How did he/she enter the US...what type of visa.
    Was there an overstay after the visa expired?

    My wife lives here in the US, came with visa with her parents and overstayed! What kind of visa, not sure what kind of visa, visitors? maybe... The other part it says...Your relative is in the US and will apply for adjustment of status to that of a lawful permanent resident at the USCIS office in: City and State

    If I'm mailing her paper work, does she or do I have to file for "adjustment of status" at the city we live in? Or can we also mail that in?

    Okay, so you wife seems to qualify for the first part..she is in the US and is eligible for AOS in the US..

    You will want to fill in the left hand side only with the city/state where you want the interviews to take place. This should be the city/state of the USCIS office closest to where you a resident today.

    You can use this web site to find the local USCIS office close to you.

    You will mail in the forms to one of the processing centers based on where you are resident, which is usually differnet from where you want to have the interviews.

    For example, if you live in Boise Idaho...you will put on question 22 Boise Idaho...but you may have to mail the forms to Chicago..This is just an example
