Section 6308(A) Charge in Pennsylvania
My question involves criminal law for the state of: PA
My son is 20. He went to a party (off campus) with his friends. Police came in (without asking for permission) and gave citations to everyone. No BAT was given. There were beers in the house. My son being under 21 was given citation (mailed to home). He didn't drink as he was just hanging out there - wrong place at the wrong time. I didn't realize this is a criminal offense. Plan to fight it in court. Any suggestion?

Not without facts. Are we to assume he had access to alcohol, knew minors were present and drinking, etc.?

Yes. There were other minors (<21) drinking beer and he would have access to alcohol if he wanted to. But he didn't. Police just gave citation to everybody who's under 21 but did nothing to guys who were over 21.
