    Can I Be Emancipated in the State of Texas
    I am 16 years old living in the state of Texas, I won't be turning 17 until August of 2010, but I've been thinking about being emancipated for a long time and think it is the best choice. I'm planing on staying in school (or taking homeschool classes at Texas Tech) and then go on to college. I have a part time job but plan on getting a full time job at the end of this school year. I would be moving in with a 20 year old friend. Is this possible and what are the requirments I must meet to be able to do so or do I even have to become emancipated if I stay in school. Obviously my mother is not on board with this.

    You must already be living separate and apart from your parents and be 100% self-supporting before you even file the petition.

    And if your parents object? The court will say no unless you can present exceedingly compelling reasons as to why it's in your best interests.

    Yes I read that, but if your parents have to approve why would we even have emancipation. When I'm seventeen and my parents under law are no longer responsible for me and i can go to big boy jail I'd hope in our society that theres a way that I can support myself as a legal adult. At 17 can my parents even tell me I have to come home.

    Yes, until you are 18 your parents have full say about what you do and where you go. If they say come home, you come home.

    You, like many other kids who post here, have a very mistaken idea about the purpose of emancipation. It is not and never was intended to be a means for you to move out of the house. Emancipation was and is intended to provide a minor with legal protections when, through no fault of his own, he finds himself living on his own.

    "I want to move out and my parents don't want me to" is not a legal reason for emancipation. "My parents were killed in a car crash and I need to be emancipated so I can pay the light bill and the rent and support my younger siblings" is.
