    Accomplice to Shoplifting in CVS
    My question involves criminal law for the state of: Massachusetts
    So a friend of mine and i went to cvs because she was on her brake and was thirsty but had no money.. i knew she was going to aptempt to take the drink but i never stand by her.. this time i was unaware she took the drink until security stopped us n took us to the back.. he didnt call the cops but made us give all our info and searched both our purses. This who thing is over a drink that cost was one dollar. my question is what will happen to me? they said i cant enter the store for a year and i might get a fine.. but they did not take my picture. is there anything else i should be worried about? and will this go on my record? and also i am 17 and i had my license

    If the police were not called, you have no criminal record.

    You may, however, receive a Civil Demand and may have been entered into the National Retail Theft Database. If you receive the Civil Demand, pay it immediately, or you run the risk of criminal prosecution.

    You might consider choosing a better class of "friend" to go "shopping" with.

    i said i did not know she was shoplifting this time so how can i be considered an accomplice when i had no knowledge...

    In other words, you've shoplifted with her before and you knew she planned to steal on this visit as well.

    You told us that you knew she was going to steal so you didn't "stand by her". You may not have known that she shoplifted by virtue of not standing near her, but as you said you knew she had no money, knew she planned to steal, and have done this with her before.

    (As MrKnowItAll said, you have knowledge of her prior shoplifting).

    The cops were not called, but the store has a year to press charges.

    You should think seriously about what shopping with this friend could cost you. You're likely going to get a Civil Demand Letter in the mail, which will be atleast $100. If it goes to court, expect to be paying for a lawyer or a Public Defender ($250 here for a Public Defender), plus court costs and fines ($300). Next time you know a friend is going to shoplift, don't go to the store with them. Better yet, turn 'em in.

    my wordin was bad.. previous times when i did have knowlegde i wouldnt stand with her.. this time i didnt have knowledge she was takin the drink.. until the security guy came over to us.. i later discovered she had no walllet.. i had money.. if i knew she was moneyless i would have paid for it.. i hope the clears up my story.. and no i would never turn in my own friend.

    You're "wordin" isn't the only thing that is bad.

    Read what you have written. Your story has more holes than Swiss Cheese.

    Bear in mind that the store has a year to press Criminal Charges. Mugshot. Fingerprints. Oh yeah, and you can be entered into the National Shoplifter DataBase.

    I'm going to sound mean here:

    You would never turn in your friend.

    Honey, I hate to say it....but you are in trouble because of your "friend" and your poor choices. And your not turning in your friend makes you just as guilty as she.


    - Will your friend pay for your Civil Demand? That "fine" you may receive will be atleast $100, if not more.

    - If CVS files charges, will your friend pay your legal fees? The costs for your lawyer or Public Defender? Your court fines? The costs of an "Anti-Shoplifting Course"?

    Or are you out of the money yourself? All because of your friend?
