Of course you can be prosecuted after-the-fact. And with a videotape, they have a darn good case.
The odds depend upon the full facts and context. If a LP saw you stealing, the odds go up that they'll review the tape; if nobody saw anything the odds are very low.
What if the owner of the store saw it on the tape and then they told me to never come back to the store next time I came?
In this case…the owner of the store can/may tell you to “never come back” and they can still charge you.
So the answer to your original question is …Yes!
Since the store owner told you not to come back....I would definitely not go there again.
I am guessing small local store? Where the business owner would likely rather have customers in his lot instead of a cop car?
