    Do I Lose Traffic School Option
    My question involves a speeding ticket from the State of: California.
    I recently got a ticket CVC 22349a and would like to request a TBWD (Temporarily accelerated to yield to a overtaking vehicle). My question is that if im found guilty by my TBWD, do I lose my Traffic School Option that i am eligible for? Thanks in advance

    It depends on the judge. Legally speaking, you are not giving up your right to traffic school simply by opting for a TBD or a court trial. However, a judge is not under any obligation to refuse your request for traffic school if you choose either of those options.

    Based on what you've posted, the fact that you were driving in excess of the speed limit... albeit "temporarily", and regardless of the reason why, (accelerated to over take a vehicle or otherwise) does not sound like a legitimate legal argument that could afford you a decent chance at a dismissal. (In fact, you are in essence, admitting to committing the violation).

    Point is, if you're eligible for traffic school... And unless you have any other ideas for a defense (other than what you've posted), then you'd be better off taking traffic school and chalking it up as a lesson learned.

    If your point situation is critical, then yes, ask the judge to allow you to go to traffic school. If you handled yourself properly and really had a defense, the judge might go along.

    If your point situation is not critical and depending upon the points for the violation, I might take the points instead as you get them back in a year.

    The traffic school thing stays on your driving record forever and there are limits on the number of times in your life that you can use the traffic school option.

    Of course, the best thing is to be found not guilty.
