Do I need an I-94 to enter the U.S. while applying for a Green Card
    Hello,

I was asking some questons to USCIS about living in the United States permently and they said my Step-Father can sponser me, so they gave me the forms and everything, they told me ill need to get an I-94 from the U.S. Border (when coming from Canada), now the reason why I have to get a I-94 (as they say) is because ill need to put down on the form my I-94 number and information about it and also ill be in the States while filing for the Green Card.

My mom thinks that Immirgation is doing a Trap for me so when I go across the border and ask for the I-94 and tell them that I am staying in the states while my Green Card is going through, that they will reject me at the border and ban me for a few years. So what is the proper way to go across and do I really need a I-94 when entering the U.S. and applying for my Green card? I really don't want to get in trouble and well should I come across the border (entering the U.S.) with my Step FAther (U.S. Citzen/Sponsering) or my Grandfather (who is a Canadian Citizen)?

    Thank you.

I'm not sure I understand your mother's concern. Are you planning on staying in the U.S. illegally while your petition for a Green Card is being processed?

Yes, I would like to stay in the United States while my Green Card is going through.

I don't have a I-94 nor do I have a Non Immirgrant Visa, I heard it was ok to stay in the States while my papers are going through...but I am not allowed to leave the U.S. while its going through.

    is this ok?

    Consult an immigration lawyer.

I don't understand, I mean I thought immigrants who are applying for Perment Residence can apply while staying in the United States.

You are looking for legal advice pertaining to your specific situation, and want us to give you assurance that an illegal stay in the United States won't affect your attempt to gain citizenship. That type of assurance is simply not possible in a forum, so you need to consult a lawyer.
