    I'm in Henderson Nevada, and will be 16 on November 30th. I understand that one can be emancipated at that age. I've been wanting to do this since I was about 13, and soon I will be at an age where I can do something about it. (I have been working, unwillingly since I was 12 3/4) I understand that they want you financially stable but my problem is my mom owns a Dairy Queen and will not let me do anything other than my homework, chores, and work at the store. I work about 35 - 50 hours at the store every week, against my will, and don't get paid. My payment is living at the house, but I want to move out. I understand that I am supposed to have 4 months of living on my own, but I cannot, due to the fact that she calls the cops and I'm classified as a "runaway". I am trying to convey my situation the best I can, but I'm not sure if I'm getting it 100% across. What can I do with emancipation? Will they understand my case? I will have somewhere to stay until I get a job, and become sound on my feet. Will this be enough? Also, I do my school online, and as long as I can get to a library I will be fine, because I can do it on any computer with internet connection.

    Emancipation requires you to ALREADY be self sufficient. Going to live with someone else is not self sufficient.

    I also see absolutely no problem with you working at the family business. One day when you grow up and mature, you'll understand why. However, as a child, I expect you to whine and complain about it.

    I understand. I don't have the option of becoming self sufficient, although I wish to be. I don't appreciate you saying how I'm "whining" about something, when in fact I'm asking for advice. Not your opinion. I am asking for my legal options, also, I have been working there for 3 years with no option of working or not, and once I'm 18 I will be in trouble. Due to the fact that I will have very few people to go to, if any, and I will not have ANY money to my name. I don't wish to complain, so I apoligize if I came across that way but I need some help.

    Do you know how many people in this world turn 18 and don't have a dime to their name? Most of them were fine. You get a job on your 18th birthday, move out and then you can do whatever you feel like you want to do. You have no idea who you will have to go to 2 years from now, and unless you live somewhere where there are no churches and no social service agencies, you WILL have somewhere to go, if you choose to go there. You may not like the circumstances, but believe me, everyone in this world has options.

    Every 15 and 16 year old in this world has the desire to be self sufficient until they realize just how much it costs to be self sufficient and realize that you won't have NEAR the earning capacity to do so. Suck it up until you reach the age of majority and then fly away.

    Okay, again, I don't wish for your advice. I explain my situation and I want legal help. I don't wish to be wandering around aimlessly, because I wish to have thing set straight. I want to plan for my future, not wait until the last second to do a whole bunch of things to try to set it straight.
    Okay, I understand that most 15 year olds want to be self sufficient, but I am in a completely different situation. I have not had any ownership of anything in my home for several years, and we do not get along. If I do something wrong I am hit with a belt, and I can't keep putting up with that. The only people I know are the people at my work due to the fact that I have no time to go out and do anything. Let alone go to a public school to meet anyone. I don't try to play the feel sorry for me game, and I don't want anyone's pity, instead I wish for an answer on what I can LEGALLY do, not MORALLY or however you wish to percieve what your beliefs are based on.

    We don't always get what we want. I do not remember graduating from high school with thousands of dollars in the bank. I remember graduating from high school and going off to college, probably without a dime to my name. I ended up with 2 degrees and a very good paying job.

    One, you don't HAVE a home. It's your parents home. Second, neither of my children have ownership of anything in my home. My oldest is now a homeowner and a law enforcement officer. Living in his own home. We didn't get along too well when he was about your age, either. I didn't get along with my parents all too well either when I was your age. It's cyclical.

    Call the police. That's your legal option. Call Children's Services. If they feel you are being abused, they will remove you from the home. If they remove you from the home, you don't have to work 40 - 50 hrs/wk. Maybe your foster parents will allow you to have an after school job.

    They aren't required to let you go out and do anything. It's a privilege. Some kids don't get that privlege. Join a lunch organization at your school. Get some friends.

    What was the legal advice you gave? Saying that I had to be self sufficient, I have heard of possible grants that the government will give a child? I am looking for these kinds of options.

    So how are you being educated?

    I do it 100% online, I have never been to the school.

    Courts will not consider emancipation of a minor when said minor will need to rely on the government for support. Perhaps you should read the emancipation statutes.

    In order for you to be legally emancipated, you're going to bring A LOT of people in this. There are a lot of people in a courthouse. Judges, social workers, financial evaluators and the like. All of which will be all up in you and your family's business. So, which is it? Do you not want to bring anyone in on this or do you not?

    I understand. They will not allow me to lean on someone else until I get on my feet? In which case would you have a suggestion for me on what to do, legally. And where can I read the "emancipation statutes"? I am sorry but I am very naive when it comes to legal, thus the reason I came on this site.

    I did not want to, but if it were to be my only option, than I suppose I won't have a choice. I need to do something, although I'm unsure what I would do. If I am being forced to not have pay in a job I don't wish to be in, what would you suggest?

    I'm not the one to ask. I require and DEMAND that my children (my youngest is still at home) to do all kinds of work to which I don't pay him a dime and I don't feel obligated to, either. Including working at one of the family businesses.

    Again, if you feel like you're being abused, then call the police and let them conduct an investigation.
