Rent and Possession vs. Unlawful Detainer
My question involves landlord-tenant law in the State of: missouri
A rent and possession suit was under appeal and the plaintifs filed a seperate action claiming Unlawful Detainer how is it that both actions are being sought in seperate courts? a tenant has the right to pay rent and continue possession in a rent and possession case, however the plaintifs assert that the tenant does not have permission to be in possession and seeks double rents for every month defendant is in possession in the Unlawful detainer case

We can't access the procedural history or case file for either case, to try to determine what's going on. If in fact the tenant has a legal right of possession due to the ruling in the first case, the tenant can bring that to the attention of the court in the second case as a defense against the second lawsuit. The tenant may want to hire a lawyer or see if he qualifies for legal aid.
