Retail Fraud 3rd Degree

My question involves criminal law for the state of: Michigan

Hi, I'm 26 and was recently caught stealing nail polishes (silly, I know) at a total of $71.86, the LP officer had me sign a voluntary statement and gave me a civil demand letter ($200) and called the police. I was arrested, finger printed etc, but was allowed out on $300 bail. I also have a court date on Oct 28th in Wayne county. This is my absolute first offense of Retail Fraud - 3rd Degree and I just had a few questions:

1) I'm wondering if I need to get a lawyer before my court date? The cop said I will be arraigned, and I could decide then.

2) Also, since this is my first offense will I be able to plead down my charge, is there any way to keep this from going my record?

3) In michigan, is this charge permanent, or can it be expunged?

1) It's always best to retain counsel BEFORE you go to court. If you cannot afford to do so, plead Not Guilty at your arraignment and ask for a Public Defender.

2) You may be eligible for diversion, but you'll need an attorney's help to get it.

3) As long as you don't get yourself into any more trouble, you may apply for an expungement five years after you complete your sentence. (For you, that's probably going to be probation.)

Thanks! Are you aware of what the diversion program is like in michigan? Also will the probation involve reporting to someone in person? as I'm currently looking for jobs, and not necessarily in the same state. If anyone knows, please let me know!
