    Repo Fee Charged but Nothing Repoed
    My question involves an auto loan or repossession in the State of: Georgia

    My husband received a phone call from the place he purchased his motorcycle from (buy here, pay here type place), telling him if he didn't pay the amount he was past due by closing today they would come and repossess the bike tonight. After he paid them the money this afternoon they informed him he would also owe a repossession fee of $350 by next week. The bike was never repossessed. This was the first time we had heard anything about them repoing it. No one came out looking for it or trying to repo it. They said "they would have it repoed TONIGHT if not paid by closing", which he did. So my question is Can they charge him a repo fee if a repo never actually took place?
    Is there any way for us to get out of paying this fee if they can legally charge us this?
    If we are unable to pay this fee what can they do? The payments on the bike are now up to date (it was 2 months behind) and the next payment isn't for another 2-3 weeks.
    I could understand having to pay this fee if the bike were actually repossessed and we got it back but like I have said it was never repossessed!

    If the repo guy was out with the truck when they got the call that you were making good on your arrearage, it's possible that the bank incurred a repo fee despite your making a payment.
