Custody of a 13 Month Old
Last week I filed for divorce and requested 50/50 visitation. The judge denied the order, because she is still breast feeding. He offered 1 hour a day supervised. I declined because there is no nutral party near her house and I am about 1 hour away.
My daughter is eating people food, and breast feeding once a day. How do I get back in front of the judge to get this order modified? so that I can at least see my daughter. Or should I just leave the matter alone.
As it stands she will not let me see my daughter.

Was any type of visitation ordered by the judge? If so, your best bet is to exercise it as often as possible and then petition the courts for a modification in about 6 months.

Why supervised? What are you leaving out of the story? Criminal or domestic violence background? Drugs? what? and what state are you in?

Yes, why are you receiving supervised visits? There seems to be more going on then you are telling us. Also, never decline receiving any kind of visitation/custody. Something is better than nothing and it looks to the judge like if you feel the visitation with the child is an inconvenience if you can't have it your way.

He's in CA and I'm guessing it's supervised as a result of the pending felony charges...

Dg, people on here investigate previous posts. You need to be completely upfront and honest. If your DV case isn't handled and you aren't cleared, you are not going to get unsupervised visits. You need to expedite your DV case and get the charges dismissed. Do you have any previous criminal background? Does your soon to be ex? Do you have any UNBIASED character witnesses who have witnessed previous incidents? Have the court order a psychological evaluation to determine which parent would be the most fit to care for the child if she REALLY is lying about this incident. These things MAY help but no guarantee. Judges pretty much have their mind made up and tend to see things the way they want.
