How Long Do I Have to Wait for Unpaid Wages
My question involves employment and labor law for the state of: California
Instead of a check in hand Friday evening, the owners had a meeting with the 10 of us and told us that they didn't have the $$ to pay us on payday (Fri 10/09/09). They still want me to come in and work next week, I guess trusting that they will pay us. They stated hopefully by Wed or Thursday.
They have already bounced a payroll check in May and have admitted to cash flow problems...but never mentioned that they may not have payroll for the 10 of us.
I want to know what my rights are regarding unpaid salary wages...

By law, you should be paid on your regularly occuring payday. The problem is enforcing this. It is difficult since there is no penalty provided for employees who are not paid on time during the regular course of employment; unless you sue under the Private Attorney General Act for the penalties the state would otherwise collect. (even if you did, I believe you would still only keep 25%). Alternatively, you could contact the DLSE and they could explain the law to your employer. That may perhaps encourage your employer to pay you in a more timely fashion.
