My granddaughter's mother called CPS and voluntarily gave up her kids because she could not take care of them at the time due to stress and money. The mother is re-married with a 9yr old (previous relationship) and a 2yr old from her current marriage along with my granddaughter (5yrs). My son (child's father) passed away 4yrs ago. She placed the children (all 3) with myself and my husband. It has been 2mos. She is wanting the children back now. She and her husband admitted to doing cocaine, crack and pot along with excessive drinking. She also admitted to stabbing her husband (we already knew about it). Supposedly they are in counseling through CPS.
My husband and I want to keep my granddaughter permanently. What are the chances of this happening if we hire an attorney? Any advice would be greatly appreciated.

It definately won'ty hurt for you and husband to get a consult with a local attorney, and also try talking to the CPS caseworker. -

Voluntary placement from Mom through CPS no court order; Investigators want her to take Anger Mgmnt, see Psych, drug/alcohol but none of this has happened. CPS Social Svcs had her see counselor and he stated all she needed was parenting classes. She's a pill popper.
We don't hv a lot of money but would spend every dime if we thought we had a good shot at getting custody. My granddaughter has told us on numerous occasions she did not want to go home but I don't think that has any bearing on the issue.
