Got a Job Offer, Went Out to Celebrate and Got Myself in Trouble (Felony)
My question involves a background check in the State of: Washington/New York
So in this crappy times I was lucky enough to get 2 job offers from great companies as well as stay in my field which is sales. That said I resigned from my current job immediately and today was supposed to be my start date at one of the companies. However, over the weekend the college i went to had a football game and I decided to celebrate with friends. Afterwords I waited at my friends apartment complex and some resident tried to kick me out because I was acting drunk. I was intoxicated and argued with him and left within 2 minutes to wait outside. Before my friend had a chance to show up the police showed up and the person i spoke to accused me of threatening him (along with many other lies) so I got charged with Residential Burglary. Good thing everything is on camera and this person will be discredited and the case should be dismissed according to just about any attorney I talked to.
However, this came up on my background check as well as the fact that I had a warrant issued in regards to this case. The warrant information in regards to this case is either an error or outdated. Basically I had to post bail for this and that bail had to be transferred to superior court. I went to the superior court to see if there was a warrant out and it said that there was no warrant. The reason I say this is because the HR lady I spoke with seemed to be most concerned with this and asked my to send her a proof showing that there is no warrant. She barely mentioned anything about the felony charge.
What my main concern is that the hiring manager in my city doesn't mind this. Or so she said. She even guided me through how to explain myself to the HR manager at the company headquarters. At this point I'm simply wondering if they are simply looking for ways not to hire me after the offer was made or there is a chance that they actually are seeing if I'm still eligible to be hired. The application asked if I was ever convicted of any crime which I was not and most likely will not. Keep in mind that at the time I filled out the application and went through a month long interview process, I had a clean record.
All I want is an answer and so far today I haven't heard back and neither has my hiring manager. If I'm not eligible to be hired they can tell me so so I can take the other job.

can they withdraw their offer for this. The application only asked if I was convicted.

They can withdraw the offer for any reason or no reason at all; and they don't have to disclose why they did so.

why can't they tell me so right away. In that case I'm assuming there's still a chance I might get a job. I mean the offer sheet was signed already and as I mentioned today was supposed to be my first day. They sent me a letter to explain my situation so hopeuflly i did a good job explaining that and there's still a chance. Another company didn't seem to mind it.

got a call, they are still reviewing and reasearching the information and was told that they would get back to me with a decision today possibly. I don't see what's there to review, obviously i was charged and and theres no arrest warrant. If this disqulifies me from being hired why is it so hard just to say so

geez - do you want the job or not? Be patient and let them figure it out. Or constantly call them and harass them and see what good that will do for you:wallbang:

You seem to think that this is something they are deliberately holding up on just to screw with you. There are probably decision makers at several levels involved in this. It's not a decision that a responsible employer makes all in a minute. But I can promise you, if you keep pestering them for an answer RIGHT NOW, the answer is going to be, So long and don't let the door hit you on the way out.
No one made the decision to act like an idiot but you. If the consequences of your actions mean having to wait for an employer to make a decision, and if they don't want to make an immediate decision just to satisfy your impatience, whose fault is that? (HINT - Not the employer's.)
