My question involves criminal law for the state of: New Mexico

I am being charged with ag*ravated ind*cent expo*ure, a fourth degree felony sex crime. I have no criminal history. I was wondering if conviction of the crime would prevent me from having custody of my toddler.

I am being represented by a public defender because I cannot afford a private attorney, but I haven't been able to contact him or his secretary. I have never even met or seen the guy but i have a ton of questions that need to be answered.

Depending upon exactly what happened, it could raise concerns with a custody court.

The short answer is yes. Upon conviction you will be (A) Sent to jail. (B) Put on probation where you will most likely not be allowed contact with minors for at least a short term. or (C) Somehow you skate off the charge and then find out that just the fact that you had been charged with a sex crime, interferes in your ability to gain custody of your minor child.
