Visitation Rights
My question involves a child custody case from the State of: Texas
My husband currently does not have access to our 3 children thru a TRO...he has a sexual offense charge against him on our daughter. Our divorce is going to be finalized in 2 weeks and I really just wanted to know what I'm up against. Does the court usually award the offending parent supervised visitation or terminate their rights due to such charges pending? My child would be devastated to have to see her father...she saw him at the mall and had drawbacks for weeks!!! Please offer a clue...

I'm not sure, but I would assume, depending on how perverted those sexual charges are, that the father will get supervised visits. I think it takes A LOT to have the judge terminate a parents rights, because he still is the parent (whether or not he's a good one is for the judge to decide). List the facts, and your concerns. Be flexible, I have found that judges like that. Maybe having the child have a psych evaluation or having the child talk with a court appointed mediator will show the courts that it's best if they don't have any contact, if you honestly believe that's the best thing for her, and not because you are mad at the father.... try to take the emotions out and think clearly.
