    Felony Probation Violation
    Chicago, IL & Michigan

Okay people I'm kinda freaking out here. I have been on felony probation 9 months out of a 24 month probation sentence. This initial charge happened in Chicago, IL and was for a felony retail theft that occured November 2008.

I have been trying to complete a state transfer for about 4 months now (very long process) FROM Illinois to my home town back in Michigan. I was given the OK from the IL courts for the state transfer but some paperwork and address issues have held up the transfer from being OK'd in Michigan. For the past 4 months I have been unlawfully living in my homestate of Michigan. My PO in Chicago is fully awair of this and althought she has told me I am obviously not SUPPOSED to be in Michigan, she has been pretty much looking the other way because she is aware of my situation

<< IN A NUTSHELL >> I was born and raised in Michigan & NEVER been in trouble with the law there. Me and GF moved to Chicago for 8 months and things went bad and I got a felony for stealing lots of merch from a store. I got on probation and let them know I was planning to move back to my home in michigan cus I know I will keep out of trouble there. Me and GF were receiving death threats in Chicago and though I knew it was unlawfully for me to leave the state, I let my PO know the situation and continued reporting to her while living in MI.

NOW the courts have caught on to me being out of my designated state and have violated me for it and now I need to appear in court on OCT 5th. This is the FIRST violation I have got in 9 months of probation.

I AM rly scared now because I don't know what will happen. I am afraid I will got to jail or worse, PRISON! This is a class 4 felony and holds a 1-3 year max prison sentence. This is the FIRST time I have EVEN been in trouble with the law. Is it likely that the judge will be very hard on me? I know it is possible that I could go to jail but is that very likely? Considering other than this minor violation I have been doing everything else I need to do (Keeping in contact with my PO, paying off my fines, working 2 jobs).

I know it's hard to say how the judge will respond to this but I anyone could tell me what is a REALISTIC outcome, I would REALLY appreciate it! Thanks for any advise guys!

That depends entirely on the judge.

We really can't answer that. It is entirely dependent on the judge. If he wants to play hardball, you can kiss your freedom goodbye. If he doesn't, you might just get a finger waggle and a tongue lashing.

We really and truly cannot tell you what's going to happen to you.

Take a lawyer to court with you.
