    Retail Theft in Pennsylvania
    My question involves criminal law for the state of: Pennsylvania.. I was arrested yesterday for shoplifting just over $200. I've never been arrested before. I have a few questions about this...

    1. Were they supposed to read me miranda rights before they put cuffs on me and took me back to the station?

    2. What kind of consequences am i facing?

    3. Should I get a lawyer?

    1. They don't have to Mirandize you until they question you.

    2. Restitution, fines, probation. As a first offender, jail is unlikely, but not completely out of the question. You may also be presented with a Civil Demand. If you are, pay it, or they can drag you into court for that, too.

    3. Heavens, yes. I'm in agreement with Abraham Lincoln's assessment that a man who represents himself in court has a fool for a client. You have the right to do so, but having the right to do so doesn't necessarily make it a good idea.

    If you can't afford private counsel, plead Not Guilty and ask for a Public Defender.
