Combine My Ex's Florida and Tennessee Dui's
My question involves criminal law for the state of: Florida/Tennessee

I am battling my ex-husband for custody of my 2 year old son he has never even seen. I want to combine my ex-husband's DUI records, so he will face felony charges. Only if he is a felon, can I get sole custody. He has 5 DUI's in Florida- all of which he plead down, etc. He got a DUI in Tennessee last year, but due to a clerical error, they recorded his DL as Tennessee, although the number is that of his FL license. He served one year probation, and walked away. They treated it as a first offense. Is there any way I can rat him out and notify Florida of Tennessee's DUI, or vice versa? Please help me, my child's safetly and mental health at are stake.

i think thats double jeopardy and i think th it was the state's responsibility to know its on case against him. I think it is too late. Did you not know his info DURING his trial?

I din't know about it until after his probation was over. He disappeared before my son was born and I have just recently tracked him down and his criminal activity by using what I know about where he is and the internet.

i dont think they can do anything.. Its not "his fault" they diddn't use what they had. The states are so big on recognizing each others driving offenses so idki why they diddnt but i dont think he lied to them so i dont think they can undo anything.
