    Possibility of House Arrest
My question involves criminal law for the state of: Pennsylvania

My dad has been 20 years clean and had relapse. Then he started to have problems someone said my dad had drugs in his house. the police went in and found a 1.9 grams of heroin. They charged him with possession with intent to deliver. We bailed him out. After three months they found 54 grams of cocaine in his car and a small 22 in his house hidden inside a plant and other stuff. He to plea guilty for the 2 counts of possession with intent to deliver and possession of firearm. They offered him 36 months. He is currently in a methadone program, counseling, and seeing a psychologist. Five months ago he had an accident in a go-kart. He recently had a surgery where they took a bone from his back and placed it in his foot because he had broken his ankle. His doctor sent him four months of rest. Ever since his accident he has been clean. His sentencing is the 16th of October. He needs a lot of therapy and he probably has another surgery. Due to his current medical condition is he eligible for house arrestor what is your opinion? Thanx in advance.

He needs to be talking to his lawyer.

He injured his ankle five months ago, so he's had four months of rest (plus one extra). What's the medical issue now?

Note that he must discuss with his methadone provider the possibility that he will be incarcerated, so he can be medically prepared. I don't know your state's policies, but in some states prisons let methadone patients detox "cold turkey", even if they end up going into seizures. He won't get methadone in prison.
