Underage Minor Lied About Age
My question involves criminal law for the state of: Illinois
Back in 2006, I became preganent to my now 2 year old son. While there were a few men who could have been the father. I was living a wild life at the time. There was one who lied about his age he told me was 18/19 who was really 16 years old. He told me the truth after I found out that I was to far along. I even asked his biological mother who told me he was 18. It turns out he was even a ward of the state. I was 27 years old at the time. I have never done a DNA test because I am worried about the stautory rape charge. Looking at my son though there is a high probablitiy that he is the father. I would like to know what the truth is to tell my son some day who is father is. How long is the statute of limitations on this?

The statute of limitations is described at 720 ILCS 5/3‑5, 720 ILCS 5/3‑6 and 720 ILCS 5/3‑7. Conceivably, charges could be brought over a very long period. Whatever the limitations period, as time passes without a complaint the odds of being charged go down. Talk it over with an Illinois family lawyer.
