Transfer Probation from Between States
My question involves criminal law for the state of: Michigan and Tennessee
I am on probation for my 1st offense OWVI (misdemenor) and I do not have any violations to date. I was supposed to move to TN in October; my fiance and I own a house there. I have asked my PO about transferring my probation to TN and he first asked if I had a lawyer. When I said that I did not he said "no". I currently dont have a home here in MI, I am staying between two houses. Is there anyway to get my probation transferred to TN without starting it with my PO?

You first ask your probation officer and, if that fails, bring a motion before the sentencing court (which will very likely be denied if opposed by your probation officer). The process of transfer typically takes four or more months.
How much time do you have left on your probation? Consider talking to your probation officer about the possibility of reporting by phone or mail.

I am on probation for another 11 months. Neither the probation officer or judge want to transfer me. It isnt because I am a repeat offender or that I have violations; they'd rather me stay and go through thier rehab process because they seem to think that it is something that everyone who gets in trouble (even 1st offense like myself) needs. I was supposed to move the end of Oct to middle of Nov (somewhere in that time frame). My house is in TN. So if the probation officer and judge wont start the process I'm stuck?
