Traveling with an Approved I-130
Good Afternoon everybody.
Well my question is my husbands I-130 was approved while he was here in the U.S. on a student visa. His approval letter stated that USCIS knows he is in America and we need to file the I-485 next. I just want to know if he is able to travel by plane, train, or automobile because we are living in California but we want to go to New York. There are better oppurtunities for me there.

You mean, within the continental United States, or directly from the continent to and from Hawaii and Alaska? There are no border crossings involved. Is there something you haven't told us that makes you think a problem might arise?

This is a tricky question. The key question is what is his status in the US? Is the student visa still valid? If not, and you apply for the I-485, once it is approved he is sort of in a "pending" status
If the status is okay, then he should be free to travel within the US as much as he wants.
In the past, airlines had not really been checking immigration status on flight within the U S...just that the government issued ID was valid. However, I have seen comments that airlines are now starting to check...
The easiest answer is to file the I485 asap as well as the I-765 work authorization. With the work authorization, he can get a valid state resident identifcation and can use that as a valid US government issued ID.
