    Obtaining Information for a Self Represented Case
    This is a cross post due to the nature of the questions asked and the originla forum in which they were presented - http://www.expertlaw.com/forums/show...957#post348957

    How can I go about getting a copy of a statement that a party gave to an insurance agent?
    How can I obtain a copy of phone records around the time of the accident for the other driver, as I believe the driver was on the phone and not observing the traffic around them?

    If the other driver is subpoena to court, will I be notified ahead of time by the prosecutor or court, or will I be suprised in court? Meaning should I prepare to cross-examine the other driver before hand or just once I am notified, hence the desire for the documentation listed above.

    If this is in traffic court, the subpoena process is outlined in the other thread. You don't have unlimited discovery in traffic court. For discovery in other courts, read the court rules linked in the other thread.
