Mother wants to change son's last name to new married name
I have a 6 year old son with an ex-girlfriend. We have never been to court and I take him every other week as well as paying child support every week. I am on the birth cert as the father and he has my last name. We are now both married to other people and have other children as well in our current relationships. My question is my son told me in confidence that his mother wants to change his last name to her current married name without telling me. Can she do this? I do not want my son to have someone else's name, and her reasons for doing so is she wants her 2 kids to have the same last name so there is no confusion. She wanted to change his last name a few years back as well, but I said NO. Now she thinks she can change it without telling me. Is this possible without my consent, and if she doen chage his name, what recourse do I have. I live in New York.

A person can change their name for a fee. But, it must be published in the local newspaper for aprox 7 consecutive days. For the the name to change on the Social Security Card, the mother would have to present the "legal Name Change" document, identification for the child and herself. If she was requesting the name of the Father to change on Social Security Records , she would then have to show a legal Adoption and an ammended Birth Certificate indicating the 'new' Fathers name.
