Is Marriage Possible During Citizenship Processing
Hi,
I married my partner last year in our home country but as were both in a hurry to come back, we did not get a marriage license. Now, my spouse has cleared the second stage of citizenship, ie, finger printing and soon has an appointment for an interview. My spouse has mentioned in his application about us being married and also my name. Now, as we don't have a marriage license and because of which my spouse filing for my marriage based Green Card will be a problem, will we getting married here again create problems in my spouse's naturalization process?
We have an appointment to get married in a few days, is it a good idea for us to get married while the process for naturalization is on or wait for it to complete?
Re: Is Marriage Possible During Citizenship Processing
It's always advisable that you keep to whatever information you wrote down in an application when it comes to USCIS because the smallest mistake could cost both you & your spouse. If when applying your spouse stated you were married,he'll be obliged to produce a marriage license that matches the dates he stated u got married.Good luck but i'd advise you to be truthful.

Thank you Ale.....
Yes, we too think it would not be a good idea to take any risk with USCIS. But, my problem still persists. We don't have time to go back to our home country and get a marriage cerificate nor can we do without it! Is there a way around? Is it possible that we talk to the USCIS office and explain them the situation and show them our marriage pictures and invitation and then ask them if it is advisable for us to get married for a certificate?
Re: Is Marriage Possible During Citizenship Processing
When you say you never got a marriage certificate, are you saying one was never issued at all, or that you simply didn't get a certified copy before you left?
If you just neglected to get your copy, why not write to the issuing authority in your homeland and ask for one to be sent to you?
Re: Is Marriage Possible During Citizenship Processing
Well we had very little time to get married and then get back to the US and so we were not able to apply for a marriage certificate. As far as I know, both the parties, ie, my spouse and I, need to be present to sign the application. So is it possible that we just sent the application from here and that would be approved?
Re: Is Marriage Possible During Citizenship Processing
Um...
You should see about contacting an immigration attorney RIGHT NOW.
I don't know how it works in your homeland, but here in the US, no valid marriage certificate means no valid marriage. You might not be considered legally married.
Re: Is Marriage Possible During Citizenship Processing
Yes, that is more or less the same thing in my homeland too...
I am looking for an Attorney that would help us and that is a priority now.
Thank you LawResearchMissy and Ale for your help and advise:-).
Any more information you or anybody has about my situation will be welcomed..
