    Visiting the States with a Drunk Driving Charge
    My question involves criminal records for the state of:

    Driving under the influence.


    Hello,

    I'm visiting America in two weeks time and I have a criminal record for drink driving. I was only marginally over but I got charged.

    I have completed the ESTA form online and I have been 'approved.' This is because I have answer 'No' to all the questions on the form... I have also answered these truthfully as drink driving doesn't come under 'moral turpitude.' According to the US Embassy in London I am supposed to get a VISA but with me leaving in two weeks I haven't enough time to obtain one.

    So my questions are:

    1) Will my criminal record appear on my passport?
    2) Will it be an issue at Immigration?
    3) Am I travelling illegally?
    4) If they thought it'd be a problem, would I be notified before boarding the plane?

    Oh, and I have a machine readable passport, not the new 'chip' style ones...

    All answers would be appreicated...

    1) No.

    2) Doubtful. It's DUI, not bank robbery. A single DUI charge is typically not enough to keep you out of the country. That said, do understand that even with a squeaky clean record, you can still be denied admission if the agent is feeling particularly tinpot dictator-y.

    3) No.

    4) Not necessarily. You may be questioned at Customs in the US.
