    Back child support in Michigan
    Me and my childs father just finshed the custody and vistitation process and now we are waiting on child support. The judge awarded me temporary support from him in the amount of $325 a month pending child support arrangement. This happend March 8. I just got a letter in the mail that we are scheduled to go back to court for child support on the 30th or March. My question is when I got the paper it said child support is retroactive back in December when he filed. Does that mean he has to pay back child support all the way from December when he filed. My brother stated that they might go back to when she was born which was September 29. I don't know if that's true or not. I'm also getting assistance so if he has to pay back support will that money go directly to me or the state. Thank You!

    From what you have written it would go back to when he filed. Has he been making his temporary support payments? If so, he would get credit for those payments against any adjusted support award.

    Normally the state will take its share and pass any remaining amount to you.

    Thank you aaron I kind of figured they were just going to go back to when he filed. Yes he did make a payment today for $325. He still has half of December, January, and February to pay if they are going to go back that far.

    Note that if this is a paternity action and the child is still an infant, with this being the first permanent support order, it may be possible for the court to go back beyond the petition date; that's something you would want to discuss with a lawyer who is familiar with the details of the case, if you are interested in possibly pursuing a larger arrearage.
