    Emancipation for My Son and I
    My question involves emancipation laws for the State of:
    My mom got remarried and is now trying to kick all five of her kids from previous relations out. Sending my brother where ever and me and my 3 sisters to live with our dad. That wouldn't be a problem if he didn't have two kids with his wife living in a three bedroom trailer, there's no room for us. Also I got a son on the way and I don't want DCF to take him away when he is born. Is there some way that I will be able to get emancipated. I have a job but I got to admit I still will need help from the government.

    :wallbang: all that effort to change to color but you didn't tell us the name of your state. We'd also need to know how old you are. BUT - even regardless of those two things - there is NO state that will allow a no self-supporting minor to be emancipated. The whole reason for emancipation is so you are treated as self sufficient - which you are not.

    No.

    Unless you are 100% self supporting, you cannot be emancipated no matter what state you're in. Even assuming your state will permit a minor to be emancipated - not all states will.

    I'm in Florida and 17. So what am I supposed to do? Just let him get taken away from me? Give him up? Is there really nothing i can do?

    No one is going to take your baby unless you are a danger to him. Living in an overcrowded trailer with your dad does not mean you lose custody of your child. If you choose not to put the baby up for adoption then you need to come up with a plan. Save your money etc. Have you called any of the numerous places that offer support for underage unwed mothers?

    In Florida the parents have to file the petition. Even if your mother and father are willing to do that, you would still need to prove to the court that you can fully support yourself and your child.

    How is your mother forcing you to leave?
    Is there a court order that specifies custody?
    If there is, is your mother, or father filing for a modification of that order?

    If your mother has custody, she cannot legally force you to leave, or go to your father's without a court order. if she is not providing you with a place to live, food, medical care, etc. you can try going to CPS, but other than that there's nothing you can do except go to your father's.
