Violation of Probation and Possible Jail Time
My question involves criminal law for the state of: NJ
I was placed on probation last year for a minor shoplifting charge when I first turned 18. I am now 19 and don't know what to do.. I had tested positive for THC last Feb but my PO said he wouldn't violate me because it was a minor amount and I haven't given him any trouble. I was going to court ordered therapy and was discharged because they thought they didn't have anything else to work on with me. Then in June my depression started up again and I missed my meeting with my PO for that month. I had planned on meeting up with him in July but my dad had been involved in a major motorcycle accident and was in ICU (just got home last week, but still has alot of major problems). After that I moved from Atlantic County (where I had been living) back to Gloucester County. While my Dad was in the hospital I cut back on my hours and recieved a warrant for my fines.. then I missed a simple court date in Deptford because of the warrant.. and then missed my VOP the other day because of the 2 warrants. I just recently gained more hours at work, which I'm using to pay off these warrants, and am now a full time student at college. I haven't caught any new charges since placed on probation. They were recommending 60 days in county for the VOP but with everything going on right now (school, work, father, ect) when I do finally go to court do you think they will be leniant?? I am so stressed out and don't want this hanging over my head for months.
Re: Violation of Probation and Possible Jail Time
We can't make any guesses for you. The court may be lenient, or the judge may want to play hardball and make an example of you. It could go either way.
You'd do well to speak with an attorney in your area.
