My question involves emancipation laws for the State of: nj my husbands daughter is 19 years of age and is working does he still have to pay child support she is also not going to school
What does the support order say?
well i guess in nj the law says u have to pay to 22 yrs ofage if going to school full time, but she is not attending college my husband is going to court to see if they can stop child support or at least lower the payments i have two kids of my own i think its not fair they take from my kids to support someone who is working and is old enough to support themselves
I have just enough knowledge of NJ law to be dangerous, but I know what happened to my BIL.
Yes, he MUST go back to court and apply to have it stopped. My BIL is currently having to pay back child support for all four of his children, all of whom are over 18 and none of whom are in college (one is over 22 and one has a child of her own) because in NJ it appears that child support does not stop without an application for it.
how long does it take for the court process
That is something I can't tell you - it's too dependent on how busy the specific court is.
