As you would need proof the guy was not you. And in court, it would not look good. Trying to blame someone else vs remorse.

It wouldn't do anything to benefit the OP. The person is charged with the crime, not the name. He is still the person that was arrested.
What it can do is get him additional charges, maybe. Fake ID's are illegal in many states (haven't looked at Mi). Carrying a fake ID and not correcting the situation could lead to charges for several crimes.
Re: Open Retail Fraud Case / Moving for College
pandora read sometime dude. i said i know people who have identical brothers ....its not illegal to hold someones wallet ... please this is a legal forum paying attention to details matters .
i know its no benifit to me , just stating
if they never asked if it was me and it was my brothers wallet the case would more than likely be dismissed because at that point theres no proof that the person that was arrested info could be for sure. .

wrong, wrong, wrong.
I don't care if you had Obamas license in your wallet, the facts are:
they arrested YOU
they fingerprinted YOU
the mugshotted YOU
regardless of whether the license was your or somebody elses and had your pic on it YOU committed the crime.
So, along with your misguided belief, if I was arrested and didn't have an ID on me, does that mean they could not prosecute me? Of course not. In the same vein, what difference does it make whose license you had in your wallet. It was YOU that committed the crime.
Re: Open Retail Fraud Case / Moving for College
okay well if i had obamas license and they thought it was me . they recorded all his info and released me when the court date came up , obama would be like wtf?i aint that nigga? and get it sorted out then they would try to find me . but, if i was in another state and denyed it they would have to go through alot of trouble to get it straightened and my guess is because its such a sticky situation theyd be forced to dismiss.
lol @ hypothetical scenarios ....i love law.
Re: Open Retail Fraud Case / Moving for College
no, they would not dismiss. You're missing the point. They would have your pic, your fingerprints and whatever else from the physical you. While you may have given them a false name (illegal in itself), which would make it difficult to find you, if you did end up in the legal system, they may just match your new prints to some deadbeat guy they lost when he provided a false name.
they would not dismiss; since you were already charged and essentially escaped, they would simply have a warrant for the physical "you". with no accurate name.
if they caught the physical "you", they would do what it takes to determine if that was the "you" they were looking for and then prosecute you.
and since you have already been arrested, there is no statute of limitations to stop them from prosecuting you in the future.
Re: Open Retail Fraud Case / Moving for College
Your finger prints are better then your id,if you get arrested again there gonna notice the name. If this is a misdemeanor and you have no other convictions a lawyer should be a able to arrange probation where your college is or maybe unsupervised probation. The other arrest is still there,so they will take that in to consideration.
Hire a lawyer asap and they can hopefully get this case dismissed or arrange some plea bargain quickly if a dismissal is not an option. They might be able to care of everything in one or 2 visit, maybe you won't have to appear in person. Just have to show up once to plead guilty and have your plea entered.
