Community State Law and Debts
My question involves real estate located in the State of: Arizona
My spouse has several thousand dollars in child support arears, we make monthly payments and are current on child support, we are just chipping away at the arears (just had a hiccup with business for a cpl of years and got behind in full monthly payments - our lovely system felt no need to modify even temporarily).
Currently there are no liens on our home - as it is in my name only and the property was not acquired during our marriage. However if we move forward with our plan to build a new home would this home be subject to liens for child support and student loans? The home we build will continue to be in my name only, I don't know if that matter in a community state.

You're asking us to guess at what could happen in the future, following events that have yet to occur. If your spouse is effectively using the house as a means of hiding money from his ex, I don't rule out the possibility that eventually she'll try to take action against the house. Whether that could work will depend on the facts as they then exist.
