What Happens to a Lawsuit if the Defendant Changes Her Name
I'm in California. I'm going to small claims court soon with an ex-girlfriend who has since gotten married. She refused to repay a debt she owed me, and said she would no longer deal with me and I could deal with her husband, and that he would contact me. He never did, and I never tried to contact him. So my question is, am I under obligation to speak to him since she tried to pass the whole situation off to him? Or do I have to agree to deal with him? Will this have any effect on the case?
Also, I sued her under her maiden name, but I believe she has now legally changed it to her married name. Will that pose a problem in court? I should mention, she did countersue, so she has received the paperwork and acknowledged it.

You are/were under no obligation to talk to her husband. Because she is counter suing it is the same as her acknowledging that the person you served with her maiden name is one and the same person with the married name.
