Caught Shoplifting
My question involves criminal law for the state of: michigan
i got caught shoplifting at walmart. i'm 20 years old. i was given a misdomener ticket for retail fraud, so i assume that it's 3rd degree.
I've got a couple questions about the "fine" that walmart can issue me. From my understanding for this particular item i'll be charged 200 dollars as mandated as a maximum by michigan law.
I have a question about the part that states that all items must be returned to the store in saleable condition or refund the money that they cost.(not an exact quote)
This isn't the first time that i've stolen from walmart so i assume that they've got me on camera taking other stuff. Will they be able to charge me for those other items because of this? or am i worried over nothing.
I know that what i've done was wrong, but if they backcharge me for all of these items with the 200 dollar fine that they have the right to give i'll be in a whole lot of hurt......

Ok, a couple of things:
- One: Stop shoplifting. Now.
- Two: Realize that YOU got yourself into this mess. So if you are in a world of financial hurt, YOU brought it upon yourself.
Now...take a deep breath.
My Civil Demand letter read the same. I had never done it before. So...
My suggestion is: Get a Criminal Defense Lawyer to handle your case. Even a Public Defender is going to cost you some money.
Pay the Civil Demand when you receive it. Pay by credit card or money order, keep the receipt that you sent it. In court, you will want to show you paid it.

i've deffinetly done both of those things already, but it's still worrying the hell out of me. If anyone has any idea weather they have the right to backcharge, or if they'll only charge for the incident to which they caught me?
I understand that they probably have facial recognition software, but over the past 6 or so months i've lost quite a bit of weight and my face doesn't look the same anymore, i told them that my brother looked a lot like me and the guy commented that he had a twin as well(assuming that i meant he was my twin). The guy recorded this in the conversation log as a part of the events that occured.
So still....with the fact that my face has changed a little bit, and the fact that they think i have a twin. With no authority to investigate as to weather or not i do have a twin, do they have the right to charge me for anything that they've seen "someone that looks a lot like me" take?

You need to be honest here. Getting caught in a lie will not look good in court.
Not to mention that you could get your brother in trouble. Your brother who did NOT do it.
It was you.
They probably do not have anything on you.
But just start by being honest with yourself. Why try to get your brother in trouble when HE did not do it, but YOU did?
